Florida’s 2025 legislative sessions are in full swing. House and Senate chamber members have put forward a proposed bill entitled “The Fallen Tree Act.” If passed, the bill would create a strict liability standard for trees that fall from one property onto another and cause damage to the neighboring property. The owner of the fallen tree would be 100% liable for expenses associated with damage it causes. The bill also opens the opportunity for property owners to remove their neighbor’s trees if the branches or roots are growing on or over their property parcels. Watch below to learn more:
