Our client was an elderly widow living in Boynton Beach, Florida. Her air conditioning duct system in her attic collapsed for unknown reasons, permitting hot attic air into the cold-blowing A/C system. This caused a build up of humidity in the system, which eventually permitted severe toxic mold growth. The running of the system allowed the mold to spread throughout the home. Our client’s insurance company quickly denied the claim, concluding that the damage was long-term in nature. Our law firm sued the insurance company and argued by the express terms of the insurance policy, the claim was covered. We also filed paperwork asserting that the denial of coverage was in delivered in bad faith. Evidence uncovered during the case revealed the weakness of the insurer’s position.
