Post-Loss Conditions: What to Do After Filing a Florida Insurance Claim
In Part 7 of the Master Your Insurance Policy series, Attorney Edward Jimenez explains your post-loss conditions, the duties you must satisfy after a loss to keep your claim alive. Miss one, and even a fully covered claim can be denied. Make sure you also understand when your damage is covered in the first place.
Give Prompt Notice
Your policy requires you to report a loss promptly, and Florida law sets strict deadlines, generally one year from the date of loss for a new hurricane or windstorm claim. Do not wait. Reporting late is one of the most common reasons claims are denied outright.
Protect the Property From Further Damage
You have a duty to mitigate, meaning you must take reasonable steps to prevent additional damage, such as tarping a roof or stopping a water intrusion. Keep receipts; these emergency measures are typically reimbursable, as we covered in Part 5 on additional coverages.
Document and Submit a Proof of Loss
Your insurer can require a sworn proof of loss and supporting records. Photograph all damage, keep an inventory, and save every estimate, receipt, and piece of correspondence. The homeowner with the best records almost always recovers the most.
Cooperate, Including Examinations Under Oath
Policies require reasonable cooperation, which can include producing documents and sitting for a recorded examination under oath (EUO). What you say is recorded and can be used to limit your claim, so it is wise to have an attorney prepare you before any EUO.
