Small city, canal drainage and a busy highway edge

South Miami covers about 2.3 square miles, yet it drains through a canal to Biscayne Bay and sits along US-1 between Coral Gables and Pinecrest.

The city was chartered on June 24, 1927, and its current manager-commission structure dates to a 1953 charter reform. City Hall is at 6130 Sunset Drive, and the same Sylva Martin Building houses both the Building Division and Code Enforcement. Because the city runs its own permit counter and its own code officers, a repair, a violation notice or a flood question at a South Miami address goes to South Miami staff, not to Miami or Coral Gables.

Jimenez Legal works from Coral Springs, in Broward County, for clients throughout Florida, licensed in every Florida court. We take property damage and insurance claims, injury cases, HOA and condo disputes, and construction and contract matters. Our fee is contingent, meaning no fee unless we recover, and the first consultation costs nothing. Phone or form both work.

Flash flooding and repetitive loss in a city with its own flood file

South Miami has published its own analysis of properties that flooded repeatedly, and it names the storms and the drainage problems behind those losses.

The city's repetitive loss analysis says South Miami sits about 1.5 miles inland from Biscayne Bay and drains to the bay through the C-2 Snapper Creek Canal. It describes overbank flooding after prolonged rain and flash flooding when heavy rain outpaces the drainage system or debris blocks it. It adds that tidal influence can make things worse: if heavy rain falls during high tide, the canal system drains more slowly. The analysis ties flood insurance claims to Hurricane Irene in 1999, Tropical Storm Leslie in 2000 and Hurricane Katrina in 2005, and names Hurricane Wilma in October 2005 as the last storm with a major flooding impact on the city as of that report. It says flash flooding has damaged residential and commercial buildings and closed streets when water overtopped the road.

The same document gives a snapshot as of March 30, 2017: 859 flood insurance policies covering more than $254 million, and 88 paid losses totaling $1,222,364.14. Eight repetitive loss properties were unmitigated as of January 2017, and the city noted two had since been demolished. The city entered the Community Rating System on May 1, 2013, and the report describes it as Class 7. These are dated figures, not current ones. For a claim today, what matters is your own policy and how the loss happened. Florida generally requires notice of a new hurricane or windstorm claim within one year of the date of loss, and we can review your paperwork against that clock.

01

US-1 and the state roads around the city

The city's analysis says it is served by US-1, which runs through the southern part and on toward Coral Gables and Pinecrest, plus Florida 976 on the northern border and the Palmetto Expressway to the west. After a crash, the exact roadway and intersection help identify the responsible agencies.

02

The Metrorail station at SW 72nd Street

The South Miami Metrorail station sits at SW 72nd Street and US-1, and Dadeland South is the line's southern terminus. If you were hurt walking to or from a station, we look at the crossing, the sidewalk and who maintains each one.

03

Hospital campus and emergency care

Baptist Health South Miami Hospital at 6200 SW 73 Street runs an emergency department around the clock. Whatever happened, the first emergency visit creates records that matter later. Keep discharge papers, bills and follow-up instructions together and bring them to us.

04

Sunset Drive shops and construction

Sunset Drive carries retail and restaurants, and the city limits construction hours: weekdays 7 a.m. to 6 p.m., limited Saturday non-residential work, and none on Sundays. Injuries at a store, restaurant or job site raise questions about ownership and control that we work through early.

South Miami questions

Straight answers for South Miami residents.

Fees, deadlines and what to do after a loss or an injury.

Ask us about your situation ↗
Who checks a South Miami property for flood and drainage issues?

The city's flood safety page says flood safety is the owner's responsibility and directs residents to the Planning and Zoning Department, 305-663-6326, for property-specific flood and drainage reviews. Ask for that review before or after a loss, and keep any written answer with your insurance file.

Where do I pull a permit or schedule an inspection in South Miami?

The city's Building Division at 6130 Sunset Drive handles both. Its page lists the permit counter as open 8 a.m. to 3 p.m. on weekdays, and says to call before 3:45 p.m. with your permit number to book an inspection for the next business day. The division's number is 305-663-6355.

What are the deadlines after hurricane or windstorm damage?

Florida generally requires notice of a new hurricane or windstorm claim within one year of the date of loss. Once the insurer has notice, it must generally pay or deny within 60 days. If either date is close, or a payment looks too low, send us the policy and letters.

Does fault affect an injury claim in Florida?

Yes. Florida uses modified comparative negligence, so recovery is barred if you are more than 50 percent at fault. Also, the 2023 Florida change shortened the deadline for most negligence lawsuits from four to two years. Both points are reasons to have someone look at the facts soon after an injury.

Do you charge for the first call, and where are you located?

The first consultation is free, and we work on a contingency fee, so there is no fee unless we recover. Our office is in Coral Springs, in Broward County. We represent clients across Florida, so you can call us or use the form without traveling.
